Terms & Conditions

“Client” means a user who posts jobs, requests quotes or engages providers through the Platform. “Service Provider” means any contractor, sub-contractor, built-environment professional (e.g. architect, engineer, QS, project manager) or supplier who lists a business on the Platform. “Content” means any text, images, files, quotes, reviews and other material submitted to the Services. “Subscription” means the recurring fee paid by a Service Provider to list and transact on the Platform.

You must be at least 18 years old and legally able to contract in South Africa. You warrant that all information you provide is accurate and kept up to date, and that you are authorised to bind any business you represent. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorised access at hello@buildersplace.co.za.

Builders Place SA is a neutral technology platform. We introduce Clients and Service Providers and provide tools to communicate, quote, track projects and leave reviews. We are not a party to any agreement concluded between a Client and a Service Provider, we do not perform construction, design or supply work, and we do not employ any Service Provider. All work, quotes, deliveries, warranties and payments are the sole responsibility of the Client and the Service Provider concerned.

Posting a job on Builders Place SA is free. You agree to provide accurate job details, to respond to quotes in good faith, to conduct your own due diligence before appointing a Service Provider, and to comply with all applicable building regulations, municipal by-laws and safety requirements. You are solely responsible for paying the Service Provider you appoint on the terms you agree with them.

To list a business, you must (a) hold all licences, registrations and insurances required by South African law for the services you offer (including, where applicable, CIDB grading, SACAP/ECSA/SACQSP registration, tax clearance and workers’ compensation), (b) accurately describe your services, areas served and pricing, and (c) honour every quote you send. You are an independent business — not an employee, agent or partner of Builders Place SA — and you assume full legal, tax and professional responsibility for the work you perform and the goods you supply.

Service Providers may list on Builders Place SA after a 30-day free trial, after which a recurring subscription of R295 per month applies (excluding optional add-ons such as the R350/month website service). Fees are billed in advance, are non-refundable except where required by law, and may be adjusted on 30 days’ written notice. If a payment fails, we may suspend your listing until the account is brought up to date.

A quote sent through the Platform is an offer by the Service Provider on the terms stated in that quote. Acceptance by the Client creates a direct contract between the two parties. Builders Place SA does not hold funds, process payments between Client and Service Provider, or guarantee performance. Both parties should retain written records and agree deposits, milestones and warranties in writing.

You agree not to:

• circumvent the Platform to avoid subscription or affiliate obligations;
• submit false, misleading, defamatory, discriminatory or unlawful Content;
• impersonate another person or business or misrepresent qualifications;
• scrape, reverse-engineer, or overload the Services;
• use the Services to send spam, phishing or unsolicited marketing; or
• upload material that infringes any third-party rights.

Verification badges reflect documents submitted by a Service Provider at a point in time and are not a guarantee of ongoing compliance, workmanship or fitness for purpose. Reviews must be honest, based on genuine experience and free of unlawful content. We may remove reviews that breach these Terms or applicable law.

Affiliates earn tiered recurring commissions (20% / 25% / 28%) on active, paid subscriptions referred through their unique link. Commissions are only earned once the referred Service Provider has moved past the free trial and paid a subscription. Fraudulent, self-referred or incentivised sign-ups are not eligible and may result in forfeiture and account termination.

The Platform, including its design, code, brand and content, is owned by Builders Place SA or its licensors and is protected by South African and international IP laws. You retain ownership of Content you submit, and grant Builders Place SA a worldwide, royalty-free licence to host, display, adapt and promote that Content solely for the purpose of operating and marketing the Services.

We process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and our Privacy Policy. By using the Services you consent to that processing, including transmission to service providers necessary to operate the Platform (e.g. hosting, email delivery, analytics).

The Services are provided “as is” and “as available”. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that any Service Provider will be suitable for your project. We disclaim, to the maximum extent permitted by law, all implied warranties including merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by South African law, Builders Place SA’s total aggregate liability arising out of or in connection with the Services in any 12-month period is limited to the greater of R1,000 or the fees you paid to us in that period. We are not liable for any indirect, incidental, special or consequential losses, including loss of profit, loss of data or damage caused by a Service Provider or Client.

You indemnify and hold Builders Place SA, its directors, employees and affiliates harmless against any claim, loss or expense (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your Content, (c) any work, quote, delivery, dispute or transaction between you and another user, or (d) your breach of any law.

You may close your account at any time. We may suspend or terminate access, remove Content, or refuse service if we reasonably believe you have breached these Terms, put others at risk, or brought the Platform into disrepute. Provisions that by their nature should survive termination (IP, liability, indemnity, disputes) will do so.

These Terms are governed by the laws of the Republic of South Africa. The parties will attempt to resolve any dispute in good faith. Failing that, the dispute will be referred to arbitration under the AFSA expedited rules in Johannesburg, save that either party may approach a court of competent jurisdiction for urgent or interim relief. Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 2008.

We may update these Terms from time to time. Material changes will be notified via the Platform or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
